Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: (a) On or about January 20, 2015, for the employees exposed to fall hazards of 27 feet while performing roofing work off of an all-terrain forklift basket that was 28 feet long on an eight-foot wide wheel base on the west side of Highway 22 in Dunn County, ND. Abatement Note: Among other methods, one feasible and acceptable method of abatement would be to follow the requirements of ANSI/ASME B56.6, Safety Standard for Rough Terrain Forklift Trucks, which includes design characteristics for the construction of platforms for elevating personnel.
