29 CFR 1926.503(c): The employer did not retrain affected employees who already had been trained but demonstrated inadequate understanding and skill required by paragraph (a) of this section: On or about January 28, 2015, employees were exposed to a fall hazard of greater than 6 feet in height to unpaved ground level below and were not being trained to recognize the hazards while installing wood decking on a rooftop without having any fall protection measures in place.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): On or about January 28, 2015, employees were exposed to a fall hazard greater than 6 feet in height to unpaved ground level below while installing wood decking on a rooftop without having fall protection measures in place. Iscuro Tobias was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1004809, citation number 1, item number 1 and was affirmed as a final order on December 16, 2014, with respect to a workplace located at 1210 North Hunt Ln., San Antonio, TX. 78251.
