On February 2, 2015, fall protection was not provided for an employee on the roof structure of a gazebo, nailing 2x4s onto the structure, exposing the employee to a fall of 8.5 feet to the ground below.

29 CFR 1926.1051(a): Stairways or ladders were not provided at all personnel points of access where there was a break in elevation of 19 inches (48 cm) or more, and no ramp, runway, sloped embankment, or personnel hoist was provided: a. On February 2, 2015, a tubular welded frame scaffold without a ladder was used to access the gazebo roof that was under construction. The scaffolds platform was 5.5 feet from the ground and the eve of the roof was 2.5 feet above the platform.
