29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided, used, and maintained in a sanitary and reliable condition wherever it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact: a. On February 2, 2015, near the cliff side of the project, the seat belt was not worn while operating a 416 F Caterpillar backhoe.

29 CFR 1926.652(a)(1):Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: a. On February 2, 2015, near the center of the project, employees worked in an 8 foot deep by 4 foot wide by 33 foot long trench between a nearly vertical soil face of Type C soil and vertical formwork that was about 6 feet high without a protective system.
