29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety. a) Jobsite, 599 Pratt Drive, Indiana, PA: On or about February 3, 2015, an employee was exposed to potential cave-in hazards while working in an unprotected excavation that was approximately 5.2 feet deep on one side and 7.5 feet deep on the other and there was not a competent person for the company to inspect the excavation prior to the employees entering it.
