29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: At this establishment, on or about July 08, 2015, and time prior thereto, the employer did not implement at the work site a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) for employees working with hazardous chemicals, such as but not limited to: 1) Low Odor Organic Mastic Remover ACC-555 with the following ingredients: a) Refined petroleum Distillates; and, b) 2-Butoxyethanol (Glycol ethers solvent group). 2) Wetting Agent & Surfactant, Brand: PENEWET; 3) Surfactant, Brand: FOSTER 32-90.

29 CFR 1926.1101(g)(1)(ii): The employer did not use engineering controls and work practices in all operations covered by 29 CFR 1926.1101, regardless of the levels of exposure, in the form of wet methods or wetting agents to control employee exposures during asbestos handling, mixing, removal, cutting, application and cleanup: At this establishment, on or about July 08, 2015, and time prior thereto, employees were involved in demolition and abatement activities, such as, but not limited to of the vinyl and mastic/glue flooring materials which contain ACM. The employer did not ensure the employees used wet methods and amended water (surfactants) in the course of removal, clean-up and disposal of the ACM flooring materials, such as, but not limited to, vinyl and mastic/glue flooring materials.
