OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:    The employer is failing to protect employees from struck by, caught between and crushing hazards associated with railcars rolling free across company property and into the production plant.  The most recent example of this was found on the job site located at 9601 F Street, Omaha, NE 68127where the employer has employees working in the rail yard when four Union Pacific ELLCON  Natl Model 8500 covered hopper rail cars rolled free from the staging area 400 meters away up the track, across the company rail yard and into the bulk unloading area; thus smashing through the dead end and the interior wall to the cleaning room.                Among other methods, feasible and acceptable methods of abatement are:      1.	The employer should take physical measures limit or prevent rail cars rolling free from previous to include but not limited to:  a.	Chocking the wheels on the rail cars as they are staged by Union Pacific.  b.	Setting the brakes on each individual rail car in effort of redundancy, to decrease the likelihood of a railcar brake failure.    2.	The employer should take procedural measures limit or prevent rail cars rolling free from previous to include but not limited to:  a.	 Developing a written checklist to be used by each shift whereby they check on all rail cars to ensure that the brakes on each car are set.  b.	Implementing an improved communication system that updates key personnel the instance the Union Pacific railroad drops off railcars in the staging area.   c.	 Utilize the Union Pacific web site to report defective cars that show mechanical issues and failures.

29 CFR 1910.132(d)(1): The employers written workplace hazard(s) assessment did not clearly identify conditions that do and do not necessitate the use of personal protective equipment (PPE) :    This was most recently evident during the inspection of the facility located at 9601 F Street, Omaha, NE 68127, where the employer has employees wearing the cut resistant gloves while using emery paper and a lathe to smooth the surface on a shaft, the lathe caught his glove thus wrapping his hand around the fast spinning shaft.

29 CFR 1910.178(a)(6): The employer did not ensure that all nameplates and markings were in place:   The employer is failing to ensure that powered industrial trucks utilized throughout the facility have legible warning and caution labels installed in accordance with the operators manual.  This was most recently evident during the inspection of the facility located at 9601 F Street, Omaha, NE 68127, where the employer has employees operating multiple forklifts throughout the facility where the data plates have been either covered by a giant bar code sticker or are illegible due to wear, preventing the operator from reading essential weight restriction information.  Instances include but are not limited to:  i.  #35 Yale Model MPE080LC tugger, serial number A803N15267Y with an illegible data plate.  ii.  #24 Yale Model MPB040AC tugger, serial number N575364 with an illegible data plate.  iii.  #944 Yale Model GLC050VXN forklift serial number A910V14771G with a covered data plate.  iv.  #938 Yale Model GLC050VXN forklift serial number A910V14849G with a covered data plate.  v.  #946 Yale Model GLC050VXN forklift serial number A910V14822G with a covered data plate.
