29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, pinch points, and moving parts:   A.) McShane Welding Company, Inc. - Wysong Shear Division III Area: On or about 2/10/2015, the hold downs on the shear were not properly guarded by the shear's fixed barrier guard.  Employees could reach under the guard to the area in, around, and under the hold downs.  B.) McShane Welding Company, Inc. - Wysong Shear Division III Area: On or about 2/10/2015, the back side of the shear was not guarded by a barrier, guardrail, fence, and/or chain devices.  The condition potentially exposed employees to the shears moving sections/components and metal material that falls from the back of the machine during the shearing action.

The press performed functions that included but were not limited bending sheet metal for electrical boxes.

29 CFR 1910.217(c)(2)(i)(b): Point of operation guard(s) on mechanical power press(es) did not conform to the maximum permissible opening(s) specified in Table 10 O-10:  A.) McShane Welding Company, Inc. - Division III Area -- Niagara Press: On or about 2/10/2015, the opening in the yellow colored fixed barrier guard did not conform to the requirements noted in the 29 CFR 1910.217 Table O-10.  The opening in the guard was at least 8-inches by 8-inches with a distance from the edge of the guard to the die of approximately 1-inch to 1.5 inches.  Table O-10 specifies a maximum guard opening of only 1/4 to 3/8-inches for a 1-inch to 1.5 inch distance. The press was utilized for activities that included but were not limited to punching thin sheets of metal for electrical boxes and shaping hooks.

McShane Welding Company, Inc. - Division III Area -- Niagara Press: On or about 2/10/2015, the yellow colored fixed barrier guard was not outfitted with special fasteners to prevent it from being by-passed or easily moved out of the way.  The guard was equipped with a simple latching device which allowed the guard to moved to the side with little effort. The press was utilized for activities that included but were not limited to punching thin sheets of metal for electrical boxes and shaping hooks.
