OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to falling object hazards:  a) Plant - On or about 02/13/15 and at times prior thereto employees operated the Rotoline DC4.00 rotational molding machine and disassembled sections of the mold to extract the finished part (plastic dumpster) with weight in excess of 200 lb. The employer did not develop a written operation procedure and did not implement administrative controls to protect employees from the accidental fall of the mold parts and/or the molded products.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.95(d)(1): When information indicated that any employee's exposure equaled or exceed the 8-hour time-weighted average of 85 decibels, the employer did not develop and implement a monitoring program:  a) Plant  On or about 02/13/15 and at times prior thereto employees assembled and disassembled rotational molds and removed/tightened bolts with a pneumatic ratchet. The employer did not monitor the noise in the plant in order to determine if a Hearing Conservation Program was required for protection of the workers. (Instantaneous readings of 88.6 dB, 104.2 dB, and 98.8 dB were observed).   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.
