OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. F/V Blue Ballard, Coastal Dock; on or about 7 February 2015, and times prior thereto; three (3) instances were noted where electrical hazards existed: (a) Engine Room: A 480 volt/3 Phase electrical panel had exposed electrical. (b) Work shop a knock out was missing on the 120 volt electrical outlet (c) Baiter area: a 120 volt orange extension cord had cut insulation and wiring taped together with black electrical tape. These conditions exposed employees to electrical shock and electrical burn hazards.

F/V Blue Ballard, Coastal Dock, Factory area: On or about 7 February 2015 and times prior thereto, the Tokai Header blade was removed and not locked out. This condition exposed employees to an amputation hazard.

29 CFR 1918.11(a): The employer used the vessel's cargo handling gear without ascertaining that the vessel had a current and valid cargo gear register and certificates in accordance with ILO 152 recommendations. F/V Blue Ballard, Coastal Dock, forward deck area: On or about 5 February 2015 and times prior thereto, the pedestal crane did not have an annual marine crane certification accomplished. The last time the crane was inspected was in June 2013. This condition exposed employees to a struck by hazard.

F/V Blue Ballard, Coastal dock, Weather deck: On about 7 February 2015 and times prior thereto, the Boom angle indicator was missing on the pedestal crane on the forward deck. This condition exposed employees to a struck by hazard.
