29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided, used, and maintained in a sanitary and reliable condition wherever it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact:     a)  On February 23, 2015, near the back of the existing house, the seatbelt was not used while operating a 420 E Caterpillar backhoe to dig around the foundation wall, exposing employees to the hazard of being struck by the backhoe striking against other surfaces.

All protruding reinforcing steel, onto and into which employees could fall, was not guarded to eliminate the hazard of impalement:     a)  On February 23, 2015, near the back of the existing house, about 75 to 100, 3/8 inch diameter rebars, that protruded about 26 to 30 inches above the foundation, were not protected, exposing employees to impalement hazards.

29 CFR 1926.600(a)(3)(i): Bulldozer and scraper blades, end-loader buckets, dump bodies, and similar equipment, were not either fully lowered or blocked when being repaired or when not in use:     a)  On February 23, 2015, near the back of the existing house, equipment was not fully lowered or blocked as the left rear tire was held about 4 inches above the ground by the backhoe stabilizers after the operator shut off and got off a 420 E Caterpillar backhoe.
