Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was exposed to a struck-by hazard while operating a forklift without using a seatbelt:          Parking lot/equipment staging area:  On or about February 19, 2015 an employee was exposed to a struck-by hazard while operating a Toyota Forklift, Model 42-5FG15, while not wearing a seatbelt.

29 CFR 1910.215(a)(4):  Work rest(s) on grinding machinery were not adjusted closely to the wheel with a maximum opening of one eighth inch:    a)  Production floor:  On or about February 19, 2015 an employee was exposed to a struck-by hazard while operating a 7" Stationary bench grinder, while grinding metal parts, while the distance between the tool rest and the grinding wheel was greater than 1/8 of an inch.    b)  Production floor:  On or about February 19, 2015 an employee was exposed to a struck-by hazard while operating a 10" Stationary bench grinder, while grinding metal parts, while the distance between the tool rest and the grinding wheel was greater than 1/8 of an inch.
