29 CFR 1926.451(g)(4)(ii): The top edge height on all suspended scaffolds where both a guardrail and a personal fall arrest system were not between 36 inches (0.9 m) and 45 inches (1.2 m) above the platform surface:Note:  For supported scaffolds manufactured and placed in service before January 1, 2000, and on all suspended scaffolds where both a guardrail and a personal fall arrest system are required, the top edge height should be between 36 inches (0.9 m) and 45     The employer failed to protect employees from fall hazards associated with working off of a form scaffold on a commercial construction site.  The most recent example of this was found on the job site located at 111 W. Harvest Dr., Lincoln, NE 68510 where the employer had employees using a form scaffold with inadequate guard rails as means of working from and inspecting the job site; specifically the form scaffolding wrapped around the wall having the rebar tied in and being prepared for a concrete pour, where the employees had to step up onto the top 16 inches of the lower wall as means of access to the back side walkway in the process exposing themselves to an eleven foot fall hazard.
