This condition exposed employees to fall hazards of up to 20 feet.

29 CFR 1926.1412(f)(5): After the qualified person determined that a deficiency on the crane was a safety hazard, the employer did not remove the equipment from service until it had been corrected: Barge CP 39: On or about February 25, 2015 and at times prior thereto, where the annual crane inspection of the Manitowoc 4000W, Serial Number 40304, Crawler Mounted Lattice Boom Crane stated the flat bar on the lower cords of the tip insert have broken welds and correction is required prior to re-certification, the employer continued to use the equipment. This condition exposed employees to struck-by hazards in the event of equipment failure.

29 CFR 1926.1431(g)(4): Eyes in wire rope slings were not fabricated with thimbles: Aurora Harbor, Barge CP 39: On or about February 25, 2015 and at times prior thereto, the four (4) wire rope slings used to hoist employees on a personnel platform were not fabricated with thimbles. This condition damaged the wire rope and exposed employees to a fall hazard of up to 20 feet in the event of sling failure.

29 CFR 1926.1431(p)(2): For lattice boom cranes: The cable was not clearly marked (so that it could easily be seen by the operator) at a point that will give the operator sufficient time to stop the hoist to prevent two-blocking, or a spotter was not used who was in direct communication with the operator to inform the operator when this point is reached. Aurora Harbor, Barge CP 39, Manitowoc Model 4000W: On or about February 25, 2015 and at times prior thereto, while hoisting personnel, the cable was not clearly marked to prevent two-blocking. This condition exposed employees to struck-by and fall hazards in the event of two-blocking.
