29 CFR 1926.62(d)(1)(i): Each employer who had a workplace or operation covered by 29 CFR 1926.62 did not initially determine if any employee was exposed to lead at or above the action level of 30 micrograms per cubic meter of air (30 μg/m3) calculated as an 8-hour time-weighted average (TWA): a) SM Painting Corporation employees working at 973 5th Ave. New York, NY 10075, removing debris and painting of structures that contained lead-based paint (48.45 %) were exposed to lead hazard. The employer did not perform an exposure assessment. The condition was noted on or about 03/02/15. NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASEFILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION NOR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.

29 CFR 1926.62(f)(2)(i): The employer did not implement a respiratory protection program in accordance with 29 CFR 1910.134(b) through (d) (except (d)(1)(iii)), and (f) through (m) for each employee required by 29 CFR 1926.62 to use a respirator: a) SM Painting Corporation employees working at 973 5th Ave. New York, NY 10075, removing debris and painting of structures that contained lead-based paint (48.45 %) were exposed to lead hazard. Employees were required to wear half face tight fitting respirators; however the employer did not develop a respiratory protection program. The condition was noted at or around 03/02/15. NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASEFILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION NOR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.
