29 CFR 1926.1101(d)(5): As supervisor of the entire project, the general contractor did not ascertain whether the asbestos contractor was in compliance with the asbestos standard, and did not require such contractor to come into compliance with this standard: a) On or about December 1, 2014, Consolidated Construction did not ensure the electrical subcontractor installing temporary lighting and temporary power at 201 Main Street Green Bay, WI complied with the requirements of 29 CFR 1926.1101 for Class III asbestos work while installing clips onto ceiling surfaces. The white textured ceiling coating was considered Asbestos Containing Material (ACM) in the Pre-Renovation Asbestos Inspection Report dated June 5, 2014.

29 CFR 1926.1101(k)(2)(ii)(C): The building owner and/or facility owner did not notify all employers of employees who work within or adjacent to the areas containing asbestos containing materials (ACM) and presumed asbestos containing materials of the presence, location and quantity: a) On or about December 1, 2014, Consolidated Construction did not ensure the electrical contractor employee installing temporary lighting and power knew where asbestos containing material was located. The electrical contractor employee installed clips, to hold up the cabling for the temporary lighting and power, into the asbestos containing white texture coating on the precast concrete ceiling throughout the facility.
