Employees who cleaned the food preparation area of splattered blood were not protected by an established Blood-borne Pathogen Exposure Control Plan.

Such training must be provided at no cost to the employee and during working hours. 29 CFR 1910.132(d)(1): The employer shall assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE). If such hazards are present, or likely to be present, the employer shall:    a) At the establishment, employees worked with contact hazards such as, but not limited to knives and slicers, and inhalation and contact hazards of chemicals such as, but not limited to, OASIS 146 Multi-Quat Sanitizer, Sanitizer Wash and Walk, orange force degreaser, oven cleaners, and grill cleaners. The employer had not conducted a workplace hazard assessment to determine the hazards of the job tasks and the personal protective equipment necessary to protect employees.
