29 CFR 1926.652(c)(2)(i): Design of support systems, shield systems, or other protective systems that are drawn from manufacturer's tabulated data were not in accordance with all specifications, recommendations, and limitations issued or made by the manufacturer: a) Between North Ave & 2nd Ave along 35, Seaside Park: Model HT8-1024, SN 147816 Trench Shield used in the approximate 10 foot deep x 24+ foot long trench for the protection of employees while connecting 42 inch ductile iron piping not properly maintained; bottom 6 foot spreader northwest end had an approximate 10 inch long split along the length where connected to the collar, top spreader northwest end deformed where attached to collar, original equipment pins replaced with rebar, on or about 03/01/15. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.1053(b)(15): Ladders were not inspected by a competent person for visible defects on a periodic basis and after any occurrence that could affect their safe use: a) Between North Ave & 2nd Ave along 35, Seaside Park: Employees were using the damaged orange fiberglass 12 foot base section of a ladder for entering and exiting the approximate 7 foot deep x 24 plus foot long x 8 foot wide trench excavation; damage included rung bent approximately 2-3 inches, missing shoes for side rails, and splits in the left side rail near the bent rung, on or about 03/10/15; b) Between North Ave & 2nd Ave along 35, Seaside Park: Employees replaced the first damaged ladder with another ladder in worse condition; orange fiberglass 24 foot extension ladder for entering and exiting the approximate 7 foot deep x 24 plus foot long x 8 foot wide trench excavation; damage included side rails had splits, approximate 1 inch x 3 inch piece of side rail missing, external guide missing, shoes missing, end cap broken, on or about 03/10/15; NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
