29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety. a) Worksite was located next to 21 James Avenue at the intersection of Howell Street and Van Winkle Avenue, Jersey City, NJ 07306 Employees were exposed to struck by and caught in hazards as the competent person on site did not perform daily inspections of the excavation on site to identify any issues that might have resulted in a cave-in. Observation was made on or about August 6th, 2018 Union Paving and Construction Co., Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.651(k)(2), which was contained in OSHA inspection number 936410, citation number 1, item number 2 and was affirmed as a final order on 11/18/2015 with respect to a workplace located at Spartan Avenue and Littleton Road, Parsippany, NJ.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). 29 CFR 1926.652(g)(1)(iii): Employees were not protected from the hazard of cave-ins when entering or exiting the area protected by shields: a) Worksite was located next to 21 James Avenue at the intersection of Howell Street and Van Winkle Avenue, Jersey City, NJ 07306 An employee was exposed to struck by and caught in hazards as the competent person on site directed the employee to enter an unprotected excavation to assist in the assembly of a shield system. Observation was made on or about August 6th, 2018 Union Paving and Construction Co., Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.652(a)(1), which was contained in OSHA inspection number 936410, citation number 2, item number 1 and was affirmed as a final order on 11/18/2015 with respect to a workplace located at Spartan Avenue and Littleton Road, Parsippany, NJ. Union Paving and Construction Co., Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.652(a)(1), which was contained in OSHA inspection number 650378, citation number 1, item number 1 and was affirmed as a final order on 1/22/2013 with respect to a workplace located at Interstate 80 East, left lanes at Exit 42A, Parsippany, NJ.
