29 CFR 1910.1200(e)(1): The employer did not develop, implement, and maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met  (Agriculture Reference: 1928.21(a)(5)):  (a) Bisconti Farms, Inc., Various Mushroom Plants, such as Plant 4, Equipment Washing Room, Mushroom Lane, Temple, Pennsylvania - Employees had exposure to hazardous chemicals, including, but not limited to, Arch Chemicals Drytec Granular, a hazardous chemical that classifies as an oxidizer and that has corrosive effects on the eyes and skin, and the employer did not develop, implement, and maintain a written hazard communication program, exposing employees to hazardous chemical exposure, on or about March 18, 2015.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area (Agriculture Reference: 1928.21(a)(5)):  (a) Bisconti Farms, Inc., Various Mushroom Plants, such as Plant 4, Equipment Washing Room, Mushroom Lane, Temple, Pennsylvania - Employees washed equipment used in growing and harvesting mushrooms.  The employees washed this equipment in a solution of Arch Chemicals Drytec Granular, a hazardous chemical that classifies as an oxidizer and that has corrosive effects on the eyes and skin, and the employer did not provide employees with information and training on the chemicals with which the employees worked, including, but not limited to, the hazards of the chemicals and where to find safety data sheets, on or about March 18, 2015.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR 1910.1200(h)(3)(iv):  The details of the hazard communication program did not include an explanation of the labels received on shipped containers and the workplace labeling system used by their employer; the safety data sheet, including the order of information and how employee could obtain and use the appropriate hazard information  (Agriculture Reference: 1928.21(a)(5)):  (a) Bisconti Farms, Inc., Various Mushroom Plants, such as Plant 4, Equipment Washing Room, Mushroom Lane, Temple, Pennsylvania - Employees washed equipment used in growing and harvesting mushrooms.  The employees washed this equipment in a solution of Arch Chemicals Drytec Granular, a hazardous chemical that classifies as an oxidizer and that has corrosive effects on the eyes and skin, and the employer did not provide employees with training on the revised hazard communication standard (HCS 2012) label elements and the new format and type of information on each section of the safety data sheets (SDSs) to ensure that when employees begin to see HCS 2012 compliant labels and SDSs in their workplace, employees understand how to use the labels and SDSs and access the information effectively, on or about March 18, 2015.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.
