OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees are exposed to respiratory illness hazards: Plant-Wide: Employees assigned to the fill-in operations (as known as spawning operations) are required to don half face elastomeric respirators and are exposed to organic dust: a) The employer did not ensure that medical questionnaires were administered confidentially, on or about December 5, 2019. b) The employer did not ensure that employees were fit tested at least annually, on or about December 5, 2019. c) The employer did not maintain respiratory protection documents such as, but not limited to, employee medical determination and fit testing records, on or about December 5, 2019. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
