29 CFR 1910.22(b)(1): Aisles and passageways were not kept clear and in good repair, with no obstruction across or in aisles that could create a hazard:    Warehouse:    There were holes in the following aisles and passageways where materials handling equipment such as powered pallet jacks and forklift trucks were in use:  a) Main Front Aisle adjacent to Aisle Q - there were cracks and two holes that were approximately 3 inches long, 2 inches wide and approximately 1/2 inch deep.  b) Aisle O-P - there were cracks and a floor hole approximately 10 inches wide, 15 inches long and 1/2 to 5/8 inch deep.

29 CFR 1910.151(c): Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use:    Warehouse:    Suitable flushing facilities for eyes and face were not provided and adequately maintained for employees who were exposed to corrosive liquids such as lead sulfuric battery acid, machine warewashing detergents such as EcoTemp Ultra Klene, Super Trump and Solid Powder, sanitizers such as Ultra San, de-liming solution such as Lime-A-Way, Tri-Star and Ultra Dry:  a) In Aisles E-F where corrosive liquids and powders were handled and stored, there were no flushing facilities.  b) The eyewash unit located adjacent to the powered industrial truck battery charging station had not been inspected on a regular basis to ensure that it functioned properly and was maintained in a sanitary condition.

Main Front Aisle near Manager's Office - a portable fire extinguisher was not mounted and identified.  b. Powered Industrial Truck battery charging area - a portable fire extinguisher was not mounted and identified.  c. Aisle R 1392A- a portable fire extinguisher was removed from its mount, placed on the floor and not -re-mounted.

29 CFR 1910.176(b): Material stored in tiers was not stacked, blocked, interlocked or limited in height so that it was stable and secure against sliding and collapse:    Warehouse:    The following materials were not adequately stacked, tiered and/or limited in height to prevent sliding and collapsing:    a) Overstock Area - a wooden pallet that held cardboard take-out food containers that was stacked on top of two (2) pallets take-out containers was damaged creating an unstable load.  b) Overstock Area - a wooden pallet that held boxes of giant drinking straws that was stacked on top of two (2) pallets of straws was damaged creating an unstable load.  c) Overstock Area - there were pallets of boxes of lunch napkins that were stacked 3 pallets high.  The weight of the top pallet was causing the boxes underneath to buckle creating an unstable load.  d) Overstock Area - a wooden pallet that held boxes of thermal paper rolls that was stacked on top a pallet of thermal paper was damaged creating an unstable load.  e) Installation Area, Aisle E (BB) - boxes of shelves were stored on a storage rack approximately 12 feet above ground on two pallets stacked on top of each other and were not secured to each other. The pallet on top was bigger than the other pallet underneath creating an unstable load.  f) Installation Area, Aisle F - a large ice bin was stored on a wooden pallet that was damaged on the bottom.  g) Installation Area, Aisle H - a cooler was stored on a damaged pallet, the joist was split.    h) Installation Area, Aisle J 5382A - a griddle was stored on a damaged wooden pallet.

OSH ACT of 1970 Section (5)(a)(1):  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards associated with being crushed or struck by falling objects:    Warehouse:  The commercial steel storage racks used to store boxes and pallets of items such as food service equipment and supplies were not maintained to prevent collapse of the racks.  Deficiencies included, but were not limited to:    a) Bottom portions of the columns of the storage rack were damaged.  Cross bracing were also damaged and/or broken off. See 1B for locations.    b)Columns of the storage racks that stored boxes and pallets of food service equipment and supplies were not anchored to the floor. See 1B for locations.    Trimark United East was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.176(b), which was contained in OSAH inspection #993039, Citation 1, Item 1, and was affirmed as a final order on September 29, 2014, with respect to a workplace located at 505 Collins Street, South Attleboro, Massachusetts.    Feasible methods of abatement include but are not limited to:  1. Provide column protectors and/or steel clad impact panels;  2. Install anchors capable of resisting shear forces caused by horizontal and vertical loads on the rack;  3. Replace columns that are significantly damaged.
