29 CFR 1910.23(a)(2): Every ladderway floor opening or platform shall be guarded by a standard railing with standard toeboard on all exposed sides (except at entrance to opening), with the passage through the railing either provided with a swinging gate or so offset that a person cannot walk directly into the opening:   (a) Employee(s) climbing a fixed ladder to access the type 3 cement silo entry way inside the main building were exposed to a fall hazard of approximately 34 feet due to no swing gate being provided for the fixed ladder opening.   (b) Employee(s) climbing a fixed ladder to access a ladder platform at the bag house inside the main building were exposed to a fall hazard of approximately 14 feet due to no swing gate being provided for the fixed ladder opening.

29 CFR 1910.132(f)(1): The employer did not provide training to each employee required to use Personal Protective Equipment that covered when PPE is necessary, what PPE is necessary, how to don, doff, adjust and wear PPE, the limitations of PPE and the proper care, maintenance, useful life and disposal of the PPE:   On or about March 28, 2015, an employee was scraping the inside walls of the type 3 cement silo in the main building wearing a body harness that was being used to suspended him at different height levels by a manual winch attached to a tripod. The employee had not received personal protective equipment training to prevent exposure to orthostatic intolerance and suspension trauma hazards.

29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:  At the establishment employees were exposed to respiratory hazards associated with the use of tight fitting full face and half face respirators in that the employer did not fully implement the written respiratory protection program worksite specific procedures as listed below:    (a) Employees were not medically evaluated to determine the employees ability to use a respirator.  (b) Employees were not fit tested to determine if the respirator fits and is able to achieve an adequate seal.  (c) Employees were not provided respirator training annually.

29 CFR 1910.146(c)(4): When the employer decided that its employees would enter permit spaces, the employer did not develop and implement a written permit space entry program that complied with 29 CFR 1910.146:  On or about March 28, 2015, an employee entered a permit required confined space in the main building to scrape off cement materials from the inside walls of a type 3 cement silo.  The employer did not implement written permit required confined space procedures as addressed below for safe entry into the type 3 cement silo.  An employee was exposed to possible asphyxiation and engulfment hazards.   (a) Employee(s) entering type 3 cement silo, a permit required confined space in the main building such were exposed to possible asphyxiation hazards due to no air monitoring equipment being provided to test atmospheric conditions for employees to use, prior to entry.   (b) Before entry was authorized into the type 3 cement silo a, permit required confined space the employer did not document the completion of measures required by preparing an entry permit to ensure that hazards associated permit required confined spaces were recognized, evaluated, and controlled prior to entering.  (c) The employer did not provide training to employees assigned to be attendants to recognize, evaluate, and control hazards associated entry into a permit required confined space entry.    (d) The employer did not evaluate the rescuers proficiency with rescue-related tasks and equipment to retrieve an entrant from a permit required confined space.
