29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s)    At the Creekside Park Apartments, 2120 Stephens Place, New Braunfels, TX 78130, on 31 March 2015 and at times prior thereto, the employer did not perform frequent and regular inspections for safety hazards such as but not limited to; fall hazards, operator certification and sanitary health concerns.  Employees were exposed to these and other hazards at the property under construction.

29 CFR 1926.602(c)(1)(ii): Modifications or additions which affect the capacity or safe operation of the equipment were made without the manufacturer's written approval.    At the Creekside Park Apartments, 2120 Stephens Place, New Braunfels, TX 78130, on 31 March 2015 and at times prior thereto, the forklift operator was supporting a job-made trash box up to the fourth floor of the building under construction with materials in the box.  After the box was partially unloaded a worker entered the box from the 4th floor balcony over the permanent balcony rail.  The box became unstable and fell to the ground. The box was not approved to be used as a personnel platform.

29 CFR 1926.602(d): Powered industrial truck operator training.  Note: The requirements applicable to construction work under this paragraph are identical to those set forth at 1910.178(l) of this chapter.    29 CFR 1910.178(l)(1)(ii) Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer did not ensure that each operator has successfully completed the training required by this paragraph (l), except as permitted by paragraph (l)(5).    On or about March 31, 2015, and at times prior thereto, the employer did not did not require the operator to complete a formal training program on the safe operation of the lift.  The employer evaluated the operator based on practical experience at the jobsite.
