On or about December 3, 2020, and at times prior thereto, three workers were unloading materials from an unapproved, job-made wooden trash box, up to approximately 18 feet high of the apartment building under construction, exposing employees to fall hazard.

29 CFR 1926.602(d): Powered industrial truck operator training. Note: The requirements applicable to construction work under this paragraph are identical to those set forth at 1910.178(l) of this chapter. 29 CFR 1910.178(l)(1)(ii): Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer did not ensure that each operator has successfully completed the training required by this paragraph (l), except as permitted by paragraph (l)(5). On or about December 03, 2020, and at times prior thereto, a worker was allowed to operate a rough terrain forklift to offload cabinetry to the 3rd and 4th floors of an apartment complex under construction without completing a formal training program on the safe operations of the lift, exposing workers to the hazard of being struck by the forklift.
