Employees engaged in masonry activities on the third level of a scaffold that was not fully planked were exposed to fall hazards of approximately 15 feet.

Employees engaged in masonry activities on the third level of a scaffold that did not have mud sills or base plates were exposed to fall hazards of approximately 15 feet.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access.  Employees performing masonry activities were accessing upper levels of a scaffold by means of the crossbraces.  A ladder was not attached exposing employees to fall hazards of approximately 15 feet.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1m) above a lower level was not protected from falling to that lower level by fall protection established in accordance with paragraphs (g)(1)(i) through (vii) of this section:  Employees engaged in masonry activities working from the third level of a scaffold without fall protection were exposed to fall hazards of approximately 15 feet.

29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets.  An employee engaged in masonry activities without head protection was exposed to struck- by hazards from falling objects.  Gaspar Fuentes was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.100(a), which was contained in OSHA inspection number 316044635, citation number 1, item number 1 and was affirmed as a final order on February 2, 2012 with a final abatement date of January 12, 2012, with respect to a workplace located at 2800 Cantey St. Fort Worth, TX 76104.
