29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure: a) Jobsite: Lot #12 Luzerine Avenue, Uniontown PA - On or about April 2, 2015, employees were working unprotected and exposed to fall hazards of between approximately 15 feet to 20 feet while installing shingles on a 6/12 sloped roof. Miller Brothers Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number #490418, citation number 1, item number 1 and was affirmed as a final order on December 19, 2012, with respect to a workplace located at the Village at Cheat Landing, Morgantown, WV 26508.

29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access; a) Jobsite: Lot #12 Luzerine Avenue, Uniontown PA - On or about April 2, 2015, employees were accessing the roof to install new shingles on a portable metal ladder that was not extended at least 3 feet from the roof landing: The fall hazard to the employees was approximately 12 feet to the ground below.
