29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  On or about April 6, 2015, employees working on the ground level at the worksite located at 30803 Breckenridge Road, Westlake, OH, were not protected from falling objects. Overhead roof work was performed as employees worked directly below this activity.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:        On or about April 6, 2015, while performing tear off  of roofing materials from a residential roof, the employer failed to ensure employees working from a 12/12 pitch roof were protected from a fall of approximately 25-30 feet by using an adequate fall protective system/ devices. The employer failed to prove infeasibility or the presence of a greater hazard. Work was being performed on site at 30803 Breckenridge Road, Westlake, OH.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a) On or about April 6, 2015, the employer failed to ensure that portable ladders used for access to the roof of the worksite located at 30803 Breckenridge Road, Westlake, OH, were extended at least 3 feet above the upper landing. Employees accessed the roof by the ladder located on the front of the house.   b) On or about April 6, 2015, the employer failed to ensure that portable ladders used for access to the roof of the worksite located at 30803 Breckenridge Road, Westlake, OH, were extended at least 3 feet above the upper landing. Employees accessed the roof by the ladder located on the west side of the house.   c) On or about April 6, 2015, the employer failed to ensure that portable ladders used for access to the roof of the worksite located at 30803 Breckenridge Road, Westlake, OH, were extended at least 3 feet above the upper landing. Employees accessed the roof by the ladder located on the east side of the house.
