29 CFR 1926.651(i)(3): Sidewalks, pavements, or appurtenant structures had been undermined and a support system or another method was not provided to protect employees from the possible collapse of such structures: a) Near marker F.1 on the Little West 12th St side of the site: On or about April 6, 2015 The sidewalk above a trench was undermined and not properly supported while employees were working below in the trench. Employees were installing the formwork for the underpinning operation in the trench below the undermined section of the sidewalk.

29 CFR 1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: a) Near marker F.1 on the Little West 12th St side of the site: On or about April 6, 2015 Employees were installing formwork for the underpinning of a column in a 14 foot deep trench which did not have a protective system. Employees were working in the trench when a section of the wall collapsed and trapped an employee.
