29 CFR 1926.652(a)(1)(ii): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph 29 CFR 1926.652(b) or 29 CFR 1926.652(c) of this section except when: excavations are less than 5 feet (1.52 m) in depth and examination of the ground by a competent person provides no indication of a potential cave-in. (a) GLH Construction, Inc., at 5821 W. County Road 54E, Bellvue, CO 80512: On and before March 23, 2015, the employer did not ensure that each employee installing irrigation pipe in an excavation was protected from cave-in, in that the protective system (sloping) was inadequate. This condition exposed employees working in a 4-4.5 foot deep trench with Type C soil and water intrusion to struck-by hazards in that an employee suffered a broken leg when a portion of the trench wall collapsed and struck the employee.
