29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c).    (a)  GLH Construction Inc, at Centre Avenue and Research Boulevard, Fort Collins, CO:  On 5/31/17, the employer did not ensure that each employee in an excavation was protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c).  Employees installed concrete pipe for a storm drain in an excavation in proximity to an existing storm drain vault.  The depth of the excavation was approximately 11.5 feet.  The soil was classified as Type B soil.  The employer had sloped the soil as the protective system for the section of the excavation in proximity to the vault.  The excavation was sloped at approximately 55 degrees.  The employer did not ensure that the slope of the excavation was no greater than 45 degrees for Type B soil.  This condition exposed employees to a cave-in hazard.

29 CFR 1926.1203(a): Before it began work at a worksite, the employer did not ensure that a competent person identified all confined spaces in which one or more of the employees it directed may work, and/or did not identify each space that was a permit space, through consideration and evaluation of the elements of that space, including testing as necessary:    (a)  GLH Construction Inc, at Centre Avenue and Research Boulevard, Fort Collins, CO:  On 5/30/17 and 5/31/17, before it began work at a worksite, the employer did not ensure that a competent person identified all confined spaces in which one or more of the employees it directed may work through consideration and evaluation of the elements of that space, including testing as necessary.  Employees installed concrete pipe for a storm drain in an excavation in proximity to an existing storm drain vault.  Two employees entered the existing storm drain vault for preparation of the connection of the vault to the concrete pipe.  The employer did not identify and evaluate the confined space.  This condition exposed the employees to a confined space hazard.
