OSH ACT of 1970 Section (5)(a)(1):  The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to chemical incompatibility hazards.     On or about April 10, 2015:      Ventron Management employees working near the pool chemical storage area located at the Shadow Lake Apartment Complex were exposed to a violent chemical reaction and explosion hazards from the improper storage of chemicals.  Incompatible chemicals such as muriatic acid and chlorine (powder and tablets) were stored next to one another.          Among other methods, one feasible and acceptable method to correct this hazard is to segregate the chemicals to separate areas of the pool storage room to ensure that the chemicals do not come in contact with one another.

29 CFR 1910.151(c): Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use.   On or about April 10, 2015:  An employee of Ventron Management, LLC, working at Shadow Lake Apartments was injured when pool chemicals he was mixing exploded into his face and eyes, and onto his body causing second degree burns and injuries.  The employer did not have an adequate means of quick drenching for emergency use.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met.    On or about April 10, 2015:  Employees performing maintenance duties at Shadow Lake Apartments are exposed to the following chemicals:  (a) maintenance chemicals such as, but not limited to lubricants/oils, gasoline, and freon;  (b) pool chemicals such as but not limited to GLB Spot Gone II, GLB 3" Chlorine Tablets, GLB Clear Blue, and Transchem Muriatic Acid.  The employer did not have a written hazard communication program.

On or about April 10, 2015: Employees working at the Shadow Lake Apartment Complex in Doraville are exposed to chemicals such as but not limited to Transchem Muriatic Acid, GLB Super Charge, J.T. Products Sodium Bicarbonate, GLB Clear Blue, Prevent Plus, GLB Large 3 Chlorine Tablets, and Spot Gone II as well as oils, gasoline, and freon.  The employer did not compile a list of the chemicals within the worksite.

On or about April 10, 2015:  Employees working at the Shadow Lake Apartment Complex in Doraville are exposed to chemicals such as but not limited to Transchem Muriatic Acid, GLB Super Charge, J.T. Products Sodium Bicarbonate, GLB Clear Blue, Prevent Plus, GLB Large 3 Tablets, and GLB Spot Gone II. The employer did not provide adequate training of the chemical hazards within the facility.
