29 CFR 1926.502(d)(17): The attachment point of the body belt was not located in the center of the wearer's back. The attachment point of the body harness was not located in the center of the wearer's back near shoulder level, or above the wearer's head.     a) Roof of residence located at 2174 Belmont Trace, Lot # 38, Powder Springs, GA: The employer allowed employees to use a Sherrill tree Mountain Climber belt (Model: 30755L) with a rope grab and attachment point that was not located in the center of the wearer's back. The attachment point was positioned at waist level of employees, exposing them to fall hazards of approximately 23-feet 6-inches.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):     a) Roof of residence located at 2174 Belmont Trace, Lot # 38, Powder Springs, GA: An employee who was not wearing a personal fall arrest system, when installing shingles and # 15 organic roof felt from an unprotected steep-sloped, 12:12 pitch, roof was exposed to fall hazards of approximately 23-feet 6-inches.      Diego Saldivar Rivera was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 314642208, citation number 1, item number 1 and was affirmed as a final order on 11/16/2011, with respect to a workplace located at 2172 Whitekirk St. NW, Kennesaw, Georgia.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed.     a) Roof of residence located at 2174 Belmont Trace, Lot # 38, Powder Springs, GA: Employees were exposed to fall hazards of approximately 23-feet 6-inches, as the side rails of a fiberglass extension ladder, used to access the roof, did not extend at least 3-feet above the upper landing.       Diego Saldivar Rivera was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1053(b)(1), which was contained in OSHA inspection number 314642208, citation number 1, item number 2 and was affirmed as a final order on 11/16/2011, with respect to a workplace located at 2172 Whitekirk St. NW, Kennesaw, Georgia.
