OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees (a) Truck 161 - On or about April 16, 2015 employees were exposed to a struck-by hazard and possible vehicle accidents due to the vehicles gear shift lock being broken. (b) Averitt Express - On or about April 16, 2015 employees were exposed to a struck-by hazard and possible vehicle accidents due to the fact several vehicles had worn tires. (c) Truck 160 & 158 - On or about April 16, 2015 employees were exposed to a struck-by hazard and possible vehicle accidents due to vehicles having worn wiper blades. (d) Truck 143 & 158 - On or about April 16, 2015 employees were exposed to a struck-by hazard and possible vehicle accidents due to vehicles having at least one brake light out. These vehicles are driven at night for a 24 hour operation. (e) Truck 143 - On or about April 16, 2015 employees were exposed to a struck-by hazard and possible vehicle accidents due to vehicle only having one operational head lamp. This vehicle is driven at night for a 24 hour operation. (f) Truck 144 - On or about April 16, 2015 an employee was exposed to a struck-by hazard due to this vehicle not having an operational seat belt installed. Both seat belt buckles were removed.

Some vehicle door latches were missing and/or broken.

29 CFR 1910.157(c)(4): The employer shall assure that portable fire extinguishers are maintained in a fully charged and operable condition and kept in their designated places at all times except during use. (a) Truck 160 - On or about April 16, 2015 employees were exposed to a fire hazard due fire equipment being in an unserviceable condition. The fire extinguisher in this vehicle was not fully charge and in the green. One vehicle caught on fire with an employee inside.
