29 CFR 1926.651(c)(2): 29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not utilized for work in trench excavations that are 4 feet (1.22 m) or more in depth: a) On or about 04-14-15 along US Hwy 10 in Menasha, employees were crawling up/down the spreader bars of a six (6) ft. H trench shield at the north end of an approximately six (6) ft. D trench to access/egress the work area.

29 CFR 1926.651(l): Walkways were not provided where employees or equipment were required or permitted to cross over excavations: a) On or about 04-14-15, employer failed to provide a walkway over an approximately 3.5 ft. wide x 8 ft. deep opening located between the wall of the trench and the trench shield for an employee that was stepping over the opening and placing one foot on the top of the trench shield to hand tools to a co-worker.

29 CFR 1926.652(g)(1)(ii): Shields were not installed in a manner to restrict lateral or other hazardous movement of the shield in the event of the application of sudden lateral loads: a) On or about 04-14-15, employer failed to backfill soil in an approximately 25 ft. L x 3.5 ft. W x 8 ft. D void between the west side of a trench shield and the trench wall prior to employees entering the shield. Employees were using hand tools from inside the 20 ft. L x 3.5 ft. W (inside dimension) x 6 ft. H trench shield which was installed in an approximately 25 ft. L x 9 ft. W x 8 ft. D trench excavation.
