29 CFR 1910.178(l)(1)(ii): The employer did not ensure that each operator had successfully completed the training required by paragraph (l), except as permitted by paragraph (l)(5), prior to permitting an employee to operate a powered industrial truck as referenced by the note contained in 1926.602(d):    a. On or about April 16, 2015, an employee operated a rough terrain forklift without first successfully completing the training required by paragraph (l), exposing the operating employee, and employees in the work area, to struck-by and crushing type hazards.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):     a. On or about April 16, 2015, six employees removing roofing material from a 3:12 pitch roof were exposed to an 8-foot, 10-inch and 13-foot, 6-inch fall hazards without the use of personal fall arrest system, safety net system or guardrail system.
