29 CFR 1926.760(a)(1): Each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems, or fall restraint systems. On or about April 17, 2015, during steel erection activities, including but not limited to installing metal framing and sheeting material, for the construction of an addition to an industrial building, the employer did not ensure employees on an unprotected side or edge were protected from a fall hazard of approximately 17.4 feet by the use of guardrail system, safety net system, personal fall arrest system, or other fall protection system. SMITH COMPANY, INC., WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD, 29 CFR 1926.760(a)(1), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 315151530, CITATION NUMBER 01, ITEM NUMBER 001, AND WAS AFFIRMED AS A FINAL ORDER ON DECEMBER 22, 2010, WITH RESPECT TO A WORK PLACE LOCATED AT 7337 CARITS CIRCLE, MASSILLON, OHIO.
