29 CFR 1926.651(a): All surface encumbrances that were located so as to create a hazard to employees were not removed or supported, as necessary, to safeguard employees:    On or about April 14, 2015, located in the area between 319 Lagonda Ave., Hamilton, Ohio, Manhole Numbers 12, 12a, & 13 and Two Mile Creek, workers were engaged in commercial construction activities installing a sanitary sewer piping system. Workers were exposed to potential cave-in and struck-by hazards in that the residential house, deck area, back yard and wooded area above the workers were not effectively supported. Although there were metal H beams installed in the sloped ground area as well as road plates along the excavation trench boxes but these procedures were not enough to properly protect workers and not in agreement with the Professional Engineering Company contracted to oversee the sewer piping project.

29 CFR 1926.651(i)(1): Where the stability of adjoining buildings, walls, or other structures was endangered by excavation operations, support systems such as shoring, bracing or underpinning was not provided to ensure the stability of such structures for the protection of employees.    On or about April 14, 20115, located in the area between 319 Lagonda Ave., Hamilton, Ohio, Manhole Number 12, and Two Mile Creek, workers were engaged in commercial construction activities installing a sanitary sewer piping system. Workers were exposed to potential cave-in and struck-by hazards in that the residential house, deck area, back yard and wooded sloped area above the workers were not effectively and/or properly supported. Although there were metal H beams installed in the sloped ground area as well as road plates along the excavation trench boxes but these procedures were not enough to properly protect workers and not in agreement with the Professional Engineering Company contracted to oversee the sewer piping project..

29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift:   On or about April 14, 20115, located in the area between 319 Lagonda Ave., Hamilton, Ohio, Manhole Number 12, and Two Mile Creek, workers were engaged in commercial construction activities installing a sanitary sewer piping system. Workers were exposed to potential cave-in and struck-by hazards in that an effective jobsite inspection was not conducted. Although inspections of the jobsite were conducted by a competent person, the inspections were not adequate in that the recommendations of the competent person were not implemented and did not satisfy the concerns of the Professional Engineering Company contracted to provide engineering and quality control expertise to manage this sewer upgrade project.

29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety.   On or about and prior to April 14, 20115, located in the Number 12 Man Hole area, workers were engaged in commercial construction activities installing sanitary sewer piping systems. Workers were exposed to potential cave-in and struck-by hazards in that the residential house, deck area, back yard and wooded area above the workers were not effectively supported.   The S. J. Louis Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard CFR 19026.651(k)(2), which was contained in OSHA inspection number 627118, citation number 1, item number 2 and was affirmed as a final order on 04/30/2014, with respect to a workplace located near the intersection of River Road & Fraine Barracks Road, Bismarck, ND.
