29 CFR 1926.1053(b)(1): When portable ladders were used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access: Worksite: When employees used a portable step ladder to access a work platform, the top of the ladder and the side rails did not extend at least three (3) feet above the work platform surface. In order to access the platform to work the employee climbed and stood on the very top step of the ladder. This exposed him to a fall in excess of six feet to the ground below.

29 CFR 1926.1053(b)(13): The top or top step of a stepladder shall not be used as a step: Worksite: Employees performing plumbing activities used a stepladder to gain access to a homemade work platform located in excess of six (6) feet above ground level. Since the ladder was too short to reach the platform, employees stood on the stop step of the ladder, exposing them to fall hazards to the ground below.
