On or about April 16, 2015 and at times prior thereto, employees working from the roof of the apartment complex were not protected by guardrail systems or other forms of fall protection. The employees were exposed to a fall hazard of approximately 40 feet.

29 CFR 1926.1431(k)(3): Before employees exit or enter a hoisted personnel platform that is not landed, the platform was not secured to the structure where the work is to be performed, unless the employer can demonstrate that securing to the structure would create a greater hazard: Worksite located at 213 W Elm. Phase 2. Stillwater, OK 74074. On or about April 16, 2015 an employee was observed climbing out of the personnel platform while it was suspended adjacent to a window without the platform being secured to the building structure exposing the employee to a fall hazard.
