29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: a) At the facility, on or about April 20, 2015 - The employer's written hazard communication program did not designate a person(s) responsible for ensuring labeling of in-plant containers. Drivers use Blue DEF which contains 32-33% urea. Health effects of exposure to urea include lung damage and irritation of the eyes, nose, throat and skin. Waste motor oil, transmission fluid and rear end oil are drained and stored in totes and in the containers of garage heaters. Waste motor oil, transmission fluid and rear end oil are flammable. b) At the facility, on or about April 20, 2015 The employer's written hazard communication program did not designate a person(s) responsible for conducting training. 29 CFR 1910.1200(f)(6)(i): Except as provided in 29 CFR 1910.1200(f)(7) and 29 CFR 1910.1200(f)(8), the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the information required by 29 CFR 1910.1200(f)(1)(i) through 29 CFR 1910.1200(f)(1)(v): a) In the Warehouse, on or about April 20, 2015 - A container of Blue DEF was not labeled, tagged or marked with the information required by 29 CFR 1910.1200(f)(1)(i) through 29 CFR 1910.1200(f)(1)(v). Blue DEF contains 32-33% urea.
