29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: (a) Rear top plate, new residential construction located at 4284 McClaren Court, Powder Springs, GA 30127: Employee was exposed to fall hazards of approximately 29-feet, 8-inches to the lower level while engaged in framing activities on the top plate without a fall protection system in place. (b) Front top plate, new residential construction located at 4284 McClaren Court, Powder Springs, GA 30127: Employees were exposed to falls of approximately 20-feet to the lower level while hoisting roof trusses up to the top plate with no fall protection system in place. Employees were both wearing a full body harness with no connection to a life-line.

29 CFR 1926.1052(c)(1)(ii): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with a stairrail system along each unprotected side or edge: (a) Stairway, new residential construction located at 4284 McClaren Court, Powder Springs, GA 30127: Employees were exposed to falls of approximately 38-inches to the concrete surface below while accessing a stairway which was not provided with a stair rail on the open side. The stairway from the concrete floor to the landing was 5 risers high and 38-inches from the lower concrete surface.
