29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user:  a.  On or about April 21, 2015, an employee used an elastomeric half-face negative pressure respirator voluntarily when grinding scrap metal throughout the yard and the employer did not establish and implement a written respiratory protection program that addressed the worksite-specific procedures such as but not limited to employee medical evaluations, and training on the maintenance and care of the respirator.

29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  a.  On or about April 21, 2015, an employee who voluntarily wore a half-face negative pressure respirator when grinding scrap metal had not been provided with a medical evaluation prior to wearing the respirator.

29 CFR 1910.134(k)(6): The employer did not provide the basic advisory information on respirators, as presented in Appendix D of 29 CFR 1910.134, in written or oral format to employees who wear respirators when such use was not required by the employer:  a.  On or about April 21, 2015, an employee who voluntarily used a NIOSH approved half-face respirator when grinding scrap metal had not received respirator training prior to initial use of the respirator.  b.  On or about April 21, 2015, employees who voluntarily used 3M NIOSH approved dustmask respirators throughout the yard when spraying Aqua Kure White and sanding concrete forms had not received respirator training prior to initial use of the respirators.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  a.  On or about April 21, 2015, employees used hazardous chemicals such as, but not limited to Aqua Kure White and Fister 50/50 Low Odor Release while working throughout the yard and the employer did not provide information and training on the health and physical hazards of these chemicals.

29 CFR 1910.1200(h)(3)(iv):   The details of the hazard communication program developed by the employer, did not include an explanation of the labels received on shipped containers and the workplace labeling system used by their employer; the safety data sheet, including the order of information and how employee could obtain and use the appropriate hazard information:  a.  On or about April 21, 2015, employees used hazardous chemicals such as, but not limited to paints, solvents, gasoline, cleaning agents, and lubricants while working at the shooting range and the employer did not provide an explanation of the new labeling system and safety data sheet.
