29 CFR 1926.501(b)(14): Each employee working on, at, above, or near wall openings (including those with chutes attached), where the outside bottom edge of the wall opening was 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches (1.0 M) above the walking/working surface, is not protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system.  a) For the Lakewood Ranch construction site at 9850 Town Center Parkway, Bradenton, FL 34202, employees were exposed to fall hazards from an unguarded, 18 inch wide wall opening above a ventilation shaft. On 04/03/2015, an employee fell 31 ft. and 11.25 inches through the kitchen shaft to the concrete surface below. As the creating employer, Colt Builders installed the studs around the kitchen shaft where there was an 18 inch gap exposing employees to fall hazards.
