29 CFR 1917.48(a)(1): Danger zones at or adjacent to conveyors were not guarded to protect employees: (a) Hogue Warner Elevator, Barge Conveyor: On or about April 21, 2015 and at times prior thereto, the 1 and 1/2 inch keyed and the two (2) 6 inch flanged shafts of the Hi-Roller motor located 43 and 48 inches respectively above the adjacent catwalk were not guarded. This condition exposed employees to caught-in hazards. (b) Hogue Warner Elevator, Barge Conveyor: On or about April 21, 2015 and at times prior thereto, a seven (7) foot section of conveyor rollers and belt directly below the Hi-Roller motor and adjacent to the catwalk was not guarded. This condition exposed employees to caught-in hazards.

29 CFR 1910.272(f)(2): The permit did not certify that the requirements contained in 29 CFR 1910.252(a) had been implemented prior to beginning the hot work operations in the grain handling facility: Hogue Warner Elevator: On or about April 21, 2015 and at times prior thereto, where hotwork permits were issued, the employer did not ensure that portable fire extinguishers were maintained in a state of readiness, including monthly inspections of such equipment. This condition exposed employees to fire and smoke inhalation hazards from the inability to quickly extinguish an incipient stage fire.
