29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed. At the residential construction site, employees using an aluminum extension ladder to access the roof with side rails that did not extend at least 3 feet above the edge of the landing were exposed to fall hazards.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest system. At the residential construction site, employees engaged in roofing activities installing roofing material without fall protection were exposed to fall hazards of approximately 11 feet to the ground below. Jorge Alberto Portillo was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 965943, Citation Number 1, Item number 2 and was affirmed as a final order on May 08, 2014, with a final abatement date of May 15, 2014, with respect to a workplace located at 242 Belmont Dr. Midlothian, TX 76014.
