29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:       On or about February 29, 2015, employees were being exposed respiratory stressors while wearing respiratory protection such as, but not limited to, a 3M half mask tight-fitting respirator to perform routine work activities such as spraying pesticides. The employer did not implement a respiratory protection program that shall include a written program, annual training, scheduled maintenancing, along with a medical evaluation and fit testing.         Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:       On or about February 29, 2015, employees were exposed to skin and eye irritation while working with chemicals such as, but not limited to, Capsil. The employer did not ensure that a written hazard communication program had been implemented that included a list of inventory chemicals and Safety Data Sheets (SDS). On or about April 16, 2015, an employee received a work-related injury involving a high pressure sprayer that resulted in an amputation to the pinky finger (left hand) and the employer failed to report the amputation to OSHA within 24 hours. 29 CFR 1910.134(k)(6): The employer did not provide the basic advisory information on respirators, as presented in Appendix D of 29 CFR 1910.134, in written or oral format to employees who wear respirators when such use was not required by the employer:        On or about February 29, 2015, the employer failed to provide Appendix D of the Respiratory Protection Standard to employees who voluntarily wore dust masks such as, but not limited to, 3M N95 Respirators (filtering facepieces), while conducting job tasks such as cleaning in the Warehouse and/or Nursery.             Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).
