29 CFR 1910.1200(e)(1): Employers did not develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also includes the following:    a). On or about 5/1/15, on site, for employees adding water to Hawker batteries on a daily basis. Employees take 10 minutes to add water to the batteries. The employees have a potential exposure to battery acid, such as sulfuric acid. The employer did not implement a hazard communication program to include a written program and training on sulfuric acid.

29 CFR 1910.1200(h)(3)(iii): Employee training did not include the measures employees can take to protect themselves from chemical hazards, including specific procedures the employer had implemented to protect employees from exposure to hazardous chemicals, such as appropriate work practices, emergency procedures and personal protective equipment to be used:    a). On or about 5/1/15, on site, for employees adding water to Hawker batteries on a daily basis. Employees take 10 minutes to add water to the batteries. 29 CFR 1910.134(c)(2)(i): Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible:  a). On or about 5/1/15, on site, for employees using a 3M N95 8210 dust mask, on a voluntary basis, when blowing out dust off the machines during preventative maintenance. The employer did not provide information contained in the Appendix D of the standard.
