OSH ACT of 1970 Section (5)(a)(1): OSH ACT of 1970 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: struck by hazards caused by the movement of the well servicing rig when lifting assembly components.    The employer is failing to protect employees from struck-by and crushing hazards while performing paving operations.  An employees leg was broken when the track of the paving machine ran over it when the employee was in a blind spot of the operator as he was backing the paving machine to wash it off at the end of the day.     Among other methods, feasible and acceptable methods of abatement are:     1)  Ensure that all employees involved in the paving operation are trained and briefed prior to working with this equipment of the hazards involving safe operating areas, spatial awareness, and blind spots and team member location are an imperative concern during the daily operations.     2)  Develop and implement an inspection protocol pertaining to the paver machines owned and operated by the company prior to every use to ensure the machines are kept in serviceable condition at all times.     3)  Install some form of monitoring device i.e. mirrors, video camera system, barrier guard, etc.  To enable the operator to be able to see any workers that may be in the blind spots on the machine.
