29 CFR 1910.106(e)(6)(ii): Grounding. Category 1 or 2 flammable liquids, or Category 3 flammable liquids with a flashpoint below 100 °F (37.8 °C), shall not be dispensed into containers unless the nozzle and container are electrically interconnected. Where the metallic floorplate on which the container stands while filling is electrically connected to the fill stem or where the fill stem is bonded to the container during filling operations by means of a bond wire, the provisions of this section shall be deemed to have been complied with.    a) The employer did not ensure that the 55 gallon metal drum containing acetone (flammable, flashpoint -4 degrees Fahrenheit) was grounded;    b) The employer did not ensure that the 5 gallon plastic container was bonded when transferring the acetone (flammable) from the 55 gallon metal drum.

29 CFR 1910.151(c): Where the eyes or body of any person may be exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body shall be provided within the work area for immediate emergency use.    The employer did not ensure that the eyewash and shower was available where sodium hydroxide (corrosive), sulfuric acid (corrosive) and WWT 3000 Plus (corrosive) were being dispensed in that the water had been shut off for the winter.

29 CFR 1910.134(c)(2)(i): An employer may provide respirators at the request of employees or permit employees to use their own respirators, if the employer determines that such respirator use will not in itself create a hazard. If the employer determines that any voluntary respirator use is permissible, the employer shall provide the respirator users with the information contained in Appendix D to this section ("Information for Employees Using Respirators When Not Required Under the Standard");   The employer did not ensure that employees received a copy of Appendix D that voluntarily wear dust masks.

29 CFR 1910.1200(g)(8): The employer shall maintain in the workplace copies of the required material safety data sheets for each hazardous chemical, and shall ensure that they are readily accessible during each work shift to employees when they are in their work area(s). (Electronic access, microfiche, and other alternatives to maintaining paper copies of the material safety data sheets are permitted as long as no barriers to immediate employee access in each workplace are created by such options.)  The employer did not ensure that material safety data sheets were readily accessible to employees in that the employer did not maintain a copy of a material safety data sheet for Touch N Tone Aerosol Topcoats (flammable).
